5. SIA Licensing and Security Personnel

Where a security activity requires an individual to hold a licence issued by the Security Industry Authority (SIA), ARK will seek to ensure that appropriately licensed personnel are deployed in accordance with applicable legal requirements.

Personnel may also be subject to appropriate recruitment, identity, right-to-work, qualification, training and vetting procedures applicable to their role.

The specific requirements for personnel will depend on the nature of the assignment and applicable legislation or regulatory requirements.

6. Client Responsibilities

Clients are responsible for providing ARK with accurate and complete information necessary for the safe and effective delivery of services.

• Fire and evacuation arrangements;

Clients must notify ARK as soon as reasonably possible of any material change that could affect the delivery or safety of the security service.

7. Quotations and Pricing

Unless otherwise stated, quotations provided by ARK are subject to the terms, validity period and assumptions specified within the quotation.

Prices may depend on factors including:

• Number of security personnel;

• Hours of deployment;

• Location;

• Travel requirements;

• Night-time or unsociable hours;

• Event size;

• Operational complexity;

• Specialist personnel;

• Equipment requirements;

• Short-notice requirements;

• Additional duties requested by the client.

Any additional services or requirements requested after acceptance of a quotation may be subject to additional charges.

All prices are subject to applicable VAT unless expressly stated otherwise.

8. Booking and Cancellation

Specific cancellation and notice requirements may be contained within the individual service agreement or quotation.

Where no separate cancellation terms have been agreed, clients should provide ARK with as much notice as reasonably possible when cancelling or changing an assignment.

Charges may apply where resources have already been allocated, personnel scheduled, equipment arranged or other costs incurred.

Any cancellation charge will be based on the agreed contractual terms and applicable circumstances and will not prevent a customer from exercising any statutory rights that cannot lawfully be excluded.

9. Payment

Unless otherwise agreed in writing, invoices are payable within the payment period stated on the relevant invoice or service agreement.

ARK reserves the right to charge interest or recover reasonable costs where permitted by applicable law and contractual terms.

Where an account becomes overdue, ARK may, subject to the applicable agreement and law, suspend future services until outstanding amounts have been resolved.

10. Emergency and Short-Notice Services

ARK may provide security services at short notice where operational resources are available.

Acceptance of a request for emergency or short-notice security does not guarantee that ARK will always be able to provide personnel or resources.

Where immediate assistance is required because of an emergency, crime, threat to life or serious incident, clients should contact the appropriate emergency service by calling 999 where appropriate.

ARK security personnel are not a replacement for the police, fire service, ambulance service or other emergency authorities.

11. Service Limitations

Security services are designed to reduce risk and support the protection of people, property and operations.

However, no security service can guarantee that:

• Crime will not occur;

• Loss or damage will not occur;

• An incident will not take place;

• An unauthorised person will never gain access;

• A security threat will always be identified;

• An alarm or monitoring system will always operate;

• A response will always prevent loss or damage.

The level of protection provided will depend on the agreed scope of services, information supplied by the client, site conditions, staffing arrangements and circumstances outside ARK's reasonable control.

12. Subcontractors and Additional Personnel

Where appropriate and subject to the agreed service arrangements, ARK may use suitably qualified subcontractors or third-party personnel to assist with service delivery.

ARK will remain responsible for managing services in accordance with the applicable agreement.

Where specific subcontractor restrictions have been agreed with a client, those restrictions will apply.

13. Equipment and Client Property

Where ARK personnel use equipment supplied by ARK, reasonable care will be taken in its use and operation.

Where equipment, access cards, keys, radios, passes, documentation or other property is supplied by the client, the client remains responsible for ensuring that such property is suitable for its intended purpose and that ARK is provided with the necessary access or permissions.

Clients must promptly report lost, stolen or compromised keys, access cards, credentials or security information.

14. Keys and Access Credentials

Where ARK provides key holding or access control services, clients must provide accurate information and ensure that keys, access devices and access credentials supplied to ARK are correctly identified.

Clients must immediately notify ARK of:

• Lost keys;

• Stolen keys;

• Changed locks;

• Changed access codes;

• Changed alarm arrangements;

• Changes to authorised contacts;

• Any other security change affecting access.

ARK cannot be responsible for delays or failures resulting from inaccurate, outdated or incomplete information supplied by the client.

15. Alarm Response

Where ARK provides alarm response services, the response arrangements will be determined by the applicable service agreement.

Response services do not guarantee prevention of loss, damage, intrusion or criminal activity.

Where required, ARK personnel may contact the appropriate emergency services or other authorised contacts in accordance with agreed procedures.

16. Incident Reporting

Where included within the agreed service, ARK may produce incident reports, occurrence logs, patrol reports, statements or other operational documentation.

Reports will be based on information reasonably available to ARK personnel at the time.

Reports are intended to provide an operational record and should not be treated as a substitute for evidence collected by law enforcement or other competent authorities.

17. Intellectual Property

Unless otherwise stated, all content on this website belongs to ARK Guarding Solutions or is used with permission.

This includes, but is not limited to:
